Freedom of testation is the freedom to execute a Will that complies with the prescribed formalities in terms of the Wills Act 07 of 1953 whereby a Testator can leave their assets to whomever they wish.
Should you pass away without leaving a Will, your assets will devolve on your intestate heirs as determined by the Intestate Succession Act 81 of 1987.
That is why it is very important to have a Will drafted by a professional to have your wishes set out in your Will and have peace of mind that your Will complies with the requirements and formalities as prescribed.
The administration of a deceased estate is a procedure followed by an executor in which the wishes of the deceased is fulfilled in line with a properly executed Will and to bring the financial affairs and administration of the estate to a successful and orderly conclusion.
All estates are reported to the master of the High Court. However, should you not leave a Will, it is also required to report the estate to the Master of the High Court so that your assets may be disposed of in terms of the Intestate Succession Act. Intestate succession means that an estate will be divided between the surviving spouse, children (if any), parents (if any) and siblings (if any) according to a set formula as set out in the Intestate Succession Act.
An executor is also required to adhere to the process and requirements as set out in the Administration of Estates Act 66 of 1965. Therefore, the reporting of the estate is an important step in the administration process and proper compliance must be given to the completion of the reporting documents to be submitted to the Master of the High Court.

La-Rissa is an admitted attorney of the High Court of South Africa.
La-Rissa joined Brits & Matthee in 2006 and, during her time with the firm, she has obtained her Legal Secretary diploma as well as her diploma in Office Management and Technology).
While working at Brits & Matthee, she developed a keen interest in the law and started her studies towards her LLB degree, which she obtained in 2015, and has been in practice ever since.
Her areas of expertise are deceased estates and wills, but she also has a particular interest in criminal law and family law
